A) examination procedures for invention: acceptance, preliminary examination,
publication,substantive examination, grant.
B) Examination procedures for utility models: acceptance, preliminary examination,
grant.
There is no earlier publication nor substantive examination for utility models.
3. Required Documents for filling a PCT Patent Application Entering the Chinese National Phase
A) instruction letter indicating:

a. title of the invention/utility model
b. PCT International filling No. and date;
c. Name(s), address(es), and nationality(ies) of applicant(s) and inventor(s)
d. Priority application date, number and country if claiming priority
e. Requesting simultaneously for substantive examination or not;
f. The due date of the entering the Chinese National Phase
g. The applicants’ name and address in Chinese |
B) Power of Attorney

There are two types of Power of Attorney: one is Power of Attorney form which need to be filed in every application; the other is General Power of Attorney which can be used to cover all future patent applications with the same applicant. |
C) PCT Application Documents

a) the International Search Report
b) the PCT International publication documents, including:the cover page of the
publication, description, claims, abstract and drawings(if any)
c) if Amendments based on PCT Article 19 have been made and the applicant wishes the
amendments to be the part of the application, the amendments need to be provided
d) if Amendments based on PCT Article 34 have been made and the applicant requests the
amendments to be part of the application, the International Preliminary Examination
Report as well as its attachments need to be provided
e) if new amendments based on PCT Article 28 or 41 is to be made, the amendments shall
be provided and filed simultaneously. |
