A)The documents required for the application
Anyone who wishes to file an application for registration shall provide the following information and documents
◇the full name and address of the applicant;
◇class and a list of designated goods or services ;
◇a clear trademark sample if the trademark is in black & white; if the trademark is
in color, we need eight (8) color samples and another one in black & white ;
◇Power of Attorney signed and sealed by the applicant and
◇In case priority is claimed,. a written declaration shall be submitted when filing
the application and a copy of the documents relating to the previous application
shall be submitted within three months
B) The application process is as follows:
a) Conduct a search

It is advisable to firstly conduct a search of the pending and existing trade marks in the records maintained by the TM Office. This is to ensure that no one else has registered the trade mark that you intend to use, particularly in the area of your business. |
b)Filing the application

Where it is confirmed that there is no similar and/or identical prior right based on the search report, the application can be filed to the CTMO. |
c) Examination to the mark

①Preliminary check to the mark
The preliminary check is a formality examination concerning the fact whether the
statements made and documents submitted shall be authentic, accurate and complete
②Substantive examination
Where an application for registration of a trademark is not in compliance with
the relevant provisions of this Law, or if the trademark is identical with or
similar to a trademark of another person that has been registered or accepted in
respect of identical or similar goods, the Trademark Office shall object the
application .
A substantive examination is proceeded to determine if the mark is registrable. |
d) Publication

Where an application for registration of a trademark is in compliance with the relevant provisions of the Laws, the Trademark Office shall accept the application and publish the same for the opposition period.
Any person and/or party may, within three months from the date of publication, file an opposition against it. |
e) Allowance for the registration

If no opposition is filed within the specified period or the opposition is not approved, the application trademark shall be registered, a certificate of registration shall be issued, and the registration shall be published. |
f) the validity of a registered trademark

The period of validity of a registered trademark shall be ten years starting from the date of registration. |
